What is the Law of Succession all about? In a very general and broad definition, it is the study as to how property can be transferred; particularly when death occurs. To perceive this subject to be similar to the Law of Trust is highly inaccurate. As the name suggests, “Succession”, we are looking at how property is transferred from one to another or how it is “succeeded”. Thus, for the main bulk of the syllabus, one will be examining at length the instrument of the will as a method of disposition of property. Although most people may consider the subject as dry and boring, but nonetheless, I beg to differ....”whereas we might happily pass through life untouched by several of the major areas of English law, we will inevitably be affected by the distribution of the estates of our loved ones and friends when they die. And how we choose to distribute our property on death may have a substantial effect on others when we ourselves die.” [1]
